General Terms and Conditions (GTC)

1. Applicability

These terms and conditions apply to all online coaching services, digital content, and social media or podcast offerings provided by the coach.

(hereinafter referred to as “Coach”)

Clients:

Private individuals who use the online coaching services

(hereinafter referred to as “Client”)

2. Subject of the Contract

The subject of this contract is the provision of online one-on-one coaching or multi-month coaching programs, as well as the provision of accompanying digital content (e.g., videos, PDFs, courses) and information via social media channels or podcasts.

3. Conclusion of Contract, Payment Terms, and Refunds

Payment is due in full at the time of booking.
Payments are processed via Stripe, PayPal, or bank transfer.
The Coach is not responsible for technical issues arising from payment processors or bank transfers.
Refunds: All sales are final. No refunds are issued for any reason, including but not limited to: change of mind, scheduling conflicts, non-participation, dissatisfaction, or failure to implement the provided content.
By booking, the Client acknowledges that they waive any right to a refund or chargeback.

4. No Guarantee of Success

Coaching is an individual development process. The Coach does not guarantee any specific results or the achievement of particular goals. The success of the coaching depends largely on the Client’s participation, openness, and personal responsibility. Coaching does not replace medical, psychotherapeutic, health-related, or legal advice or treatment.

5. Client Responsibility

By entering into the contract, the Client confirms that they:

are physically and mentally capable of participating in the coaching,
take full responsibility for deciding which coaching guidance to follow or implement,
will seek professional advice independently in the case of any existing or suspected medical or psychological conditions.

The Client bears full responsibility for their decisions, actions, and outcomes both during and outside of the coaching.

6. Services

6.1 Individual Coaching Session (The Real Love Hour)

Duration: 90 minutes per session
Scheduling: Online via the booking page; sessions conducted via Microsoft Teams
Messenger Support: Available for 7 days after the session via the agreed platform (Signal preferred), Monday–Friday, 10:00–17:00 CET. Responses are generally provided within 24 hours.
Technical Requirements: The client is solely responsible for a stable internet connection and functioning devices. The coach is not liable for technical issues on the client’s side.
Punctuality & Non-Attendance: Missed or late sessions are considered as attended and cannot be rescheduled or refunded.

6.2 Multi-Month Coaching / Mentoring Programs (Private Mentoring)

Specific terms for multi-month coaching or mentoring programs are outlined in a separate agreement at the time of booking.

7. Digital Content / Social Media / Podcast

Free content provided on platforms such as YouTube, Instagram, TikTok, and Spotify is for informational and inspirational purposes only. Social media and podcast content does not constitute individualized medical, psychological, or therapeutic advice. Use of the content is at the client’s own risk; results may vary.

8. Appointment Cancellations

Scheduled appointments are binding. Free cancellations or rescheduling are possible up to 24 hours before the appointment via email (info@coachingbymadeleine.com) or Instagram DM (@Madeleine.Wycisk). Cancellations after this deadline or no-shows will be charged in full.

9. Liability

The coach is only liable for damages caused by intentional misconduct or gross negligence. The coach assumes no liability for decisions, actions, or omissions by the client, or for the use of digital content, social media, or podcast material. Use of all content is at the client’s own risk.

10. Confidentiality

All information disclosed during the coaching sessions will be treated confidentially, unless there is a legal obligation to disclose it.

11. Copyright

All content (materials, digital resources, social media posts, podcasts) is protected by copyright and may not be reproduced or shared without the explicit consent of the coach. All content is intended for private use only.

12. Right of Withdrawal

Consumers have a statutory right of withdrawal in accordance with § 355 BGB.

Withdrawal period:

The withdrawal period is 14 days from the date of contract conclusion. During this period, the client may cancel the contract without providing any reason.

Special case for coaching services:

If the client begins using the coaching services before the 14-day withdrawal period expires, the right of withdrawal expires if the client explicitly agrees and confirms that they have been informed about the early start of the services and the loss of the right of withdrawal.

12. Governing Law & Jurisdiction
German law (Federal Republic of Germany) applies. The place of jurisdiction is the coach’s registered office, to the extent legally permitted.

13. Severability Clause
Should individual provisions of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.

Allgemeine Geschäftsbedingungen (AGB)

1. Geltungsbereich

Geltungsbereich: Diese AGB gelten für alle Online-Coaching-Leistungen, digitalen Inhalte und Social-Media- bzw. Podcast-Angebote des Coaches.

Privatpersonen, die Coaching-Leistungen online in Anspruch nehmen

(nachfolgend „Klient:in“)

2. Vertragsgegenstand

Gegenstand des Vertrages ist die Durchführung von Online-Einzelcoachings oder mehrmonatiger Coaching-Programme sowie die Bereitstellung begleitender digitaler Inhalte (z. B. Videos, PDFs, Kurse) und Informationen über Social-Media-Kanäle oder Podcasts.

3. Vertragsschluss, Zahlungsbedingungen und Rückerstattung

3.1 Die Zahlung erfolgt in voller Höhe zum Zeitpunkt der Buchung.

Zahlungen werden über Stripe, PayPal oder Banküberweisung abgewickelt.

Der Coach ist nicht verantwortlich für technische Probleme bei Zahlungsabwicklern oder Banküberweisungen.

3.2 Rückerstattung

Alle Verkäufe sind endgültig. Es erfolgt keine Rückerstattung aus beliebigen Gründen, u. a. bei Meinungsänderung, Terminproblemen, Nichtteilnahme, Unzufriedenheit, Nichtumsetzung der Inhalte

Mit Buchung erkennt die Klient:in an, dass sie auf Rückerstattung oder Chargeback verzichtet.

4. Kein Erfolgsversprechen

Coaching ist ein individueller Entwicklungsprozess. Der Coach schuldet in keinem seiner Angebote keinen bestimmten Erfolgoder das Erreichen konkreter Ziele. Der Erfolg hängt maßgeblich von der Mitarbeit, Offenheit und Eigenverantwortung der Klient:in ab. Coaching ersetzt keine medizinische, psychotherapeutische, heilkundliche oder rechtliche Beratung oder Behandlung.

5. Eigenverantwortung der Klient:innen

Mit Vertragsschluss bestätigt die Klient:in:

körperlich und psychisch in der Lage zu sein, am Coaching teilzunehmen,
eigenverantwortlich zu entscheiden, welche Impulse umgesetzt werden,
bei bestehenden oder vermuteten Erkrankungen fachlichen Rat einzuholen.

Die Klient:in trägt die volle Verantwortung für Entscheidungen, Handlungen und Ergebnisse innerhalb und außerhalb des Coachings.

6. Leistungen

6.1 Einzel-Coaching (The Real Love Hour)

Dauer: 90 Minuten pro Sitzung
Terminplanung: Online über die Buchungsseite, Durchführung per Microsoft Teams
Messenger-Support: 7 Tage nach der Sitzung über vereinbarte Plattform (Signal bevorzugt), Mo–Fr 10–17 Uhr MEZ/CET, Antworten in der Regel innerhalb 24 Stunden
Technische Voraussetzungen: Klient:in ist verantwortlich für stabile Internetverbindung und funktionierende Geräte. Der Coach haftet nicht für technische Probleme auf Seiten der Klient:in
Pünktlichkeit & Nichterscheinen: Versäumte oder verspätete Termine gelten als wahrgenommen und können nicht nachgeholt oder erstattet werden

6.2 Mehrmonatige Coaching-/Mentoring-Programme

Spezifische Vereinbarungen für das Private Mentoring und Private Mentoring Intense werden in einem separaten Vertrag bei Buchung des Mentorings festgehalten.

7. Digitale Inhalte / Social Media / Podcast

Kostenfreie Inhalte auf den Plattformen YouTube, Instagram, TikTok und Spotify dienen ausschließlich der Information und Inspiration. Social Media und Podcast-Inhalte sind keine individuelle medizinische, psychologische oder therapeutische Beratung. Die Nutzung erfolgt auf eigene Verantwortung; Ergebnisse können individuell variieren.

8. Terminabsagen

Vereinbarte Termine sind verbindlich. Eine kostenfreie Absage, bzw. Stornierung bis 24 Stunden vor Termin möglich (per Mail and info@coachingbymadeleine.com oder per DM auf Instagram @Madeleine.Wycisk). Bei späterer Absage oder Nichterscheinen wird die Sitzung vollständig berechnet.

9. Haftung

Der Coach haftet nur bei Vorsatz oder grober Fahrlässigkeit. Für Entscheidungen, Handlungen oder Unterlassungen der Klient:in sowie für die Nutzung digitaler Inhalte, Social Media oder Podcasts wird keine Haftung übernommen. Die Nutzung der Inhalte erfolgt auf eigene Verantwortung.

10. Vertraulichkeit

Alle Informationen, die im Coaching bekannt werden, werden vertraulich behandelt, soweit keine gesetzliche Offenlegungspflicht besteht

11. Urheberrecht

Alle Inhalte (Unterlagen, digitale Materialien, Social Media, Podcasts) sind urheberrechtlich geschützt und dürfen ohne ausdrückliche Zustimmung des Coaches nicht vervielfältigt oder weitergegeben werden. Die Inhalte sind ausschließlich für die private Nutzung gedacht.

12. Widerrufsrecht

Verbraucher:innen steht grundsätzlich ein gesetzliches Widerrufsrecht nach § 355 BGB zu.

Widerrufsfrist:

Die Frist beträgt 14 Tage ab dem Tag des Vertragsabschlusses. Innerhalb dieser Frist kann die Klient:in den Vertrag ohne Angabe von Gründen widerrufen.

Besonderheit bei Coaching-Leistungen:

Beginnt die Klient:in mit den Coaching-Leistungen vor Ablauf der 14-tägigen Widerrufsfrist, erlischt das Widerrufsrecht, wenn die Klient:in ausdrücklich zustimmt und bestätigt, dass sie über den vorzeitigen Beginn und den Verlust des Widerrufsrechts informiert wurde.

13. Anwendbares Recht & Gerichtsstand

Es gilt das Recht der Bundesrepublik Deutschland. Gerichtsstand ist der Sitz des Coaches, soweit gesetzlich zulässig

14. Salvatorische Klausel

Sollten einzelne Bestimmungen dieser AGB unwirksam sein, bleibt die Wirksamkeit der übrigen Regelungen unberührt
